A Critical Silence

In a speech to the U.N. General Assembly last September Barack Obama suggested that his administration's notoriously weak defense of human rights around the world would be invigorated. "We will call out those who suppress ideas and serve as a voice for those who are voiceless," he said. He went on to urge other democracies: "Don't stand idly by, don't be silent, when dissidents elsewhere are imprisoned and protestors are beaten."
Just over two months later, Secretary of State Hillary Rodham Clinton visited Bahrain, an important Persian Gulf ally that hosts the U.S. Fifth Fleet. The emirate was in the midst of a major crackdown on its opposition. Two dozen dissidents, including intellectuals, clerics and a prominent blogger, had been rounded up, charged under anti-terrorism laws and allegedly tortured. A human rights group that had received U.S. funding was taken over by the government. Human Rights Watch had concluded that "what we are seeing in Bahrain these days is a return to full-blown authoritarianism."
Clinton's response? Extravagant and virtually unqualified praise for Bahrain's ruling al-Khalifa family. "I am very impressed by the progress that Bahrain is making on all fronts - economically, politically, socially," she declared as she opened a town hall meeting. Her paeans to Bahrain's "commitment to democracy" continued until a member of parliament managed to gain access to the microphone and asked for a response to the fact that "many people are arrested, lawyers and human rights activists."
Clinton's condescending reply was a pure apology for the regime. "It's easy to be focused internally and see the glass as half empty. I see the glass as half full," she said. "Yes, I mean people are arrested and people should have due process . . . but on the other hand the election was widely validated. . . . So you have to look at the entire picture."
So much for a fresh start on human rights. Clinton's Bahrain visit reflected what seems to be an intractable piece of the Obama administration's character: a deeply ingrained resistance to the notion that the United States should publicly shame authoritarian regimes or stand up for the dissidents they persecute.
Yes, Obama made a public statement the day an empty chair represented Chinese dissident Liu Xiaobo at the Nobel peace prize ceremony, and both he and Clinton issued statements last week when Russia's best-known political prisoner, Mikhail Khodorkovsky, was convicted on blatantly trumped-up charges. But in all sorts of less prominent places and cases, the U.S. voice remains positively timid - or not heard at all.
After Egypt's terrible elections in November, in which ballot boxes were blatantly stuffed and the opposition brutally suppressed, the administration's commentary was limited to bland statements issued by "the office of the press secretary" at State and the spokesman of the National Security Council. Three weeks earlier, at a widely watched joint press conference in Washington with Egypt's foreign minister, Clinton made no mention of the elections, the crackdown or anything else related to human rights.
In Latin America, friends of the United States marvel at its passivity as Hugo Chavez and Daniel Ortega systematically crush civil society organizations and independent media. "I don't see a clear policy," Venezuelan opposition leader Leopoldo Lopez - a good example of the sort of dissident Obama promised to defend - told me.
When the administration touts its record it often focuses on the declarations it has engineered by multilateral forums, such as the U.N. Human Rights Council. The ideology behind this is that the United States is better off working through such bodies than acting on its own. The problem is that, in practice, this is not true. Set aside for the moment the fact that the U.N. council is dominated by human rights abusers who devote most of the agenda to condemnations of Israel. Who has heard what the council said about, say, the recent events in Belarus? The obvious answer: far fewer people than would have noticed if the same critique came from Obama or Clinton.
Back to Bahrain for a moment. The "entire picture" Clinton referred to is that virtually no one, outside the Bahraini royal family and the State Department, shared her judgment that the parliamentary election was "free and fair." The dissidents are still on trial; their defense lawyers resigned en masse last month because of the court's refusal to consider any of their motions.
Recently, Human Rights Watch spoke up again on behalf of Nabeel Rajab, the president of the Bahrain Center for Human Rights, who has been repeatedly harassed by security forces, prevented from traveling and called a terrorist by the state news agency.
Has the Obama administration spoken up for this relatively obscure and "voiceless" dissident? Of course not.

Oil Companies Fueling Nuclear Proliferation in Burma Complicit in Targeted Killings and Forced Labor | EarthRights International
EarthRights International released an explosive new report Energy Insecurity: How Total, Chevron, and PTTEP Contribute to Human Rights Violations, Financial Secrecy, and Nuclear Proliferation in Burma (Myanmar) on July 5, 2010 in Paris. The report describes how the oil companies Total (France), Chevron (US), and PTTEP (Thailand) have generated over US $9 billion dollars in military-ruled Burma (Myanmar) since 1998, making their Yadana Natural Gas Project the single largest source of revenue for the country’s notoriously repressive dictatorship.

The report documents how over half the total project revenue — nearly $5 billion — went directly to the Burmese military junta, and examines recent refusals from the Yadana companies to disclose their payments to the Burmese military regime. The report alleges the funds have enabled the country’s autocratic junta to maintain power and pursue an expensive, illegal nuclear weapons program while participating in illicit weapons trade in collaboration with North Korea, threatening the domestic and regional security balance.In the report, EarthRights International further asserts that gas revenues are stored in private offshore bank accounts, where the money “could be used for many purposes, including the illicit acquisition of nuclear technology and ballistic weaponry.” This follows a report by ERI in 2009 that exposed two offshore banks in Singapore as repositories of the Burmese generals’ ill-gotten gains from foreign investment including the gas project. Both named banks – the Overseas Chinese Banking Corporation (OCBC) and DBS Group – previously denied the allegations.
The report also reveals on-going, serious human rights abuses associated with the Yadana project, including the recent extra-judicial killing of two ethnic Mon villagers in the pipeline area confirmed by EarthRights International in February of this year. The report goes on to analyzes how both Total and Chevron remain liable for these and other serious human rights abuse in their home countries.
EarthRights International previously sued Unocal Corporation (now Chevron) for complicity in murder, rape, torture, and forced labor in connection to the same gas pipeline. In 2005, Unocal paid Burmese plaintiffs a confidential settlement before the company was acquired by Chevron.

Burmese rebels in India plea bargain

By JOSEPH ALLCHINA group of Burmese ethnic rebels currently held in an Indian jail will next week enter into a plea bargain in what could be a momentous final stretch in a marathon 12-year fight for justice.
The group, composed of 10 fighters from the Karen National Union (KNU) and 24 from the now-defunct National Unity Party of Arakan (NUPA), were lured in 1998 to the Indian Andaman Islands by an Indian intelligence officer named Colonel Grewal, who offered them a safe haven. He has since disappeared, and evidence suggests he may have been a double agent working for the Burmese military.
On arriving on Indian soil the group were accused of weapons smuggling; six of the men were murdered by Indian security forces and the rest placed in detention, in what has come to be known as Operation Leech.
Their trial lawyer, Akshay Sharma, speaking exclusively to DVB in Delhi yesterday, said that use of the plea bargain – a predominantly western legal concept – was exceptionally rare in India, but was beneficial to all parties.
Moreover, human rights lawyer and chief advocate on the case, Nandita Haksar, said that “the Indian intelligence community are on trial here”. Indeed an intelligence officer, speaking under condition of anonymity, was quoted in the Indian press several months after the incident as saying that defense authorities were “deliberately adopting dilatory tactics”.
The implications of guilt for the Indian security services appeared in court after a 10-year wait for a single charge sheet to be produced, with evidence that Sharma said was “full of discrepancies”.

Key evidence such as the serial numbers of the supposedly smuggled weapons did not match, whilst “security reasons” stopped the Indian security services from bringing the explosives that the accused were charged with possessing to the Kolkata trial.Lawyers have therefore suggested that the 12-year wait for a verdict and the “grey areas” have likely induced both prosecution and defence to for the plea bargain. One of the most telling of these “grey areas” was the failure by India’s own Central Bureau of Investigation (CBI) to produce key witnesses, such Colonel Grewal, the initial contact person for the freedom fighters. This was despite requests by the Indian state’s primary investigative bodies to produce this witness.
While the acquittal of the weapons smuggling charges has been “beneficial”, Haksar claimed that they conceal an ugly truth; a “hypocrisy” at the heart of Indian democracy. For whilst the 34 may soon walk free, it is now corroborated that the Indian security services have the blood of at least six Burmese rebels on their hands, while two more who were under custody “disappeared” during the course of the trial.
Their disappearance appears to be a misnomer when one considers the severity of the initial charges the Burmese were accused of. The charge of ‘waging war against the Indian state’ – a similar indictment to one brought on the Mumbai bombers – carries the maximum penalty of death, but they still managed to disappear, and no-one seems able to divulge their whereabouts, or indeed whether they are still alive. Moreoever, one of the early trial lawyers, T. Vasnatha, was murdered in what Sharma believes was an act of the Indian intelligence services.

Kyrgyz president says Uzbek barricades will be removed

BISHKEK, KYRGYZSTAN -- Kyrgyzstan's interim president instructed police Friday to begin dismantling the barricades that ethnic Uzbeks have built to protect themselves from Kyrgyz mobs, a high-risk move that could ease the refugee crisis in the nation's south but spark more violence.
In an interview after making her first trip to the region since the deadly clashes between Kyrgyz and minority Uzbeks began a week ago, President Roza Otunbayeva said she ordered local authorities to work with civil society groups and to exercise restraint as they removed the trucks, trees and concrete barriers that Uzbek enclaves are using to keep Kyrgyz out. But she said police might need to use force to complete the task if Uzbeks resist.
"There are worries, certainly," she said. "How can I not be worried? But we can't just leave it like that. This will continue and continue, and there will be closed sectors, and how can you deliver humanitarian assistance? We must move. We must do something."
Otunbayeva and her government, which took power in a violent revolt in April, have come under intense public criticism for not restoring access to the Uzbek districts. Some nationalist Kyrgyz politicians have threatened to organize militias to remove the barricades if the government doesn't act, saying Kyrgyz sovereignty over the areas is in jeopardy.In addition to clearing a path to bring relief aid to hundreds of thousands of Uzbeks who have been driven from their homes, Otunbayeva said removing the barricades will allow Kyrgyz families to search for missing relatives in ethnic Uzbek districts, help troops reestablish public order and encourage refugees to return home.
In Osh, the country's second-largest city, where the riots began, a senior police official, Kursan Asanov, set a deadline for Uzbeks to cooperate. "Within two days, access will be opened to the barricaded districts and the Uzbek communities where military forces can't enter," he said.
But the barricades have kept Kyrgyz and Uzbeks largely apart in recent days. Taking them down could result in renewed fighting between two traumatized and angry communities that accuse the other of atrocities.
The government says 223 people have been killed in the clashes, which have subsided in recent days. But the number of deaths could be 10 times higher because many victims have been buried without being taken to hospitals, Otunbayeva said.
"I think they should be very careful, and negotiate and build trust. Trying to tear down these barricades forcefully will not be received well," said Ole Solvang, a researcher with Human Rights Watch in the region, noting that many Uzbeks say Kyrgyz police and soldiers allowed mobs to rampage through their neighborhoods and even participated in the mayhem.
Solvang acknowledged that the barricades are slowing the delivery of aid to Uzbek refugees and are preventing ambulances from entering the neighborhoods. But he said Uzbeks are "afraid that if we take down the barricades, they'll be vulnerable to attacks again from ethnic Kyrgyz."
"There are good reasons why they feel insecure," he added. He noted that he and a colleague have documented that Uzbeks who leave their enclaves continue to be attacked, beaten and raped despite the government's assertion that it has restored order in Kyrgyz areas.
In a letter Friday, Human Rights Watch and another influential organization, the International Crisis Group, called on the U.N. Security Council to send a neutral police or military force to the region to establish a corridor for the delivery of aid, provide security for refugees to return home and make it possible for reconciliation programs to begin.
"The instability in southern Kyrgyzstan cannot be wished away, and without a decisive international response, there is considerable risk that widespread violence will reignite," the groups said, urging Russia and other countries that can deploy forces quickly to participate in the mission. Kyrgyzstan hosts U.S. and Russian air bases in the country's north.
Asked about the appeal, Otunbayeva expressed skepticism. "Nobody's ready to come in so far," she said.
She also acknowledged for the first time that some Kyrgyz police and soldiers may have participated in the violence. But she expressed faith in the ability of Kyrgyz prosecutors to conduct a fair investigation and said Uzbek witnesses and community groups had already provided much more evidence than Kyrgyz.
In Uzbekistan, where he was visiting a refugee camp near the Kyrgyz border, U.S. Assistant Secretary of State Robert Blake called for an international inquiry to complement the Kyrgyz probe into the violence.

Gangs, corrupt officials make illegal migrants' trip through Mexico dangerous

IXTEPEC, MEXICO -- As the Mexican government condemns a new immigration law in Arizona as cruel and xenophobic, illegal migrants passing through Mexico are routinely robbed, raped and kidnapped by criminal gangs that often work alongside corrupt police, according to human rights advocates.
Immigration experts and Catholic priests who shelter the travelers say that Mexico's strict laws to protect the rights of illegal migrants are often ignored and that undocumented migrants from Central America face a brutal passage through the country. They are stoned by angry villagers, who fear that the Central Americans will bring crime or disease, and are fleeced by hustlers. Mexican police and authorities often demand bribes.
Mexico detained and deported more than 64,000 illegal migrants last year, according to the National Migration Institute. A few years ago, Mexico detained 200,000 undocumented migrants. The lower numbers are the result of tougher enforcement on the U.S. border, the global economic slowdown and, say some experts, the robbery and assaults migrants face in Mexico.
The National Commission on Human Rights, a government agency, estimates that 20,000 migrants are kidnapped each year in Mexico.
While held for ransom, increasingly at the hands of Mexico's powerful drug cartels, many migrants are tortured -- threatened with execution, beaten with bats and submerged in buckets of water or excrement.
"They put a plastic bag over your head and you can't breathe. They tell you if you don't give them the phone numbers" of family members the kidnappers can call to demand payment for a migrant's release, "they say the next time we'll just let you die," said Jose Alirio Luna Moreno, a broad-shouldered young man from El Salvador, interviewed at a shelter in the southern state of Oaxaca.
Luna said he was held for three days this month in Veracruz by the Zeta drug trafficking organization, which demanded $1,000 to set him free. He said he was abducted by men in police uniforms and taken to a safe house with 26 others.
'Epidemic' in kidnappingsOf the 64,000 migrants detained and expelled by Mexico last year, the Mexican government granted only 20 humanitarian visas, which would have allowed them to stay in Mexico while they testified and pressed charges against their assailants.
"We have a government in Mexico that emphatically criticizes the new immigration law -- which is perfectly valid, to criticize a law with widespread consequences -- but at the same time doesn't have the desire to address the same problem within its own borders," said Alberto Herrera, executive director of Amnesty International in Mexico.
"The violations in human rights that migrants from Central America face in Mexico are far worse than Mexicans receive in the United States," said Jorge Bustamante of the University of Notre Dame and the College of the Border in Tijuana, who has reported on immigration in Mexico for the United Nations.
U.N. officials describe the kidnapping of illegal migrants in Mexico as "epidemic" in scope.
"We have definitely begun to see a greater degree of violence in the shipping of migrants north to the United States," said Juan Carlos Calleros Alarcón, a director of policy at the National Migration Institute, which is responsible for detaining and deporting illegal visitors.
He said local authorities appear to be involved in the kidnappings.
The migrants are preyed on by roving gangs that operate along the Guatemalan border. Once in Mexico, many migrants ride on dangerous freight trains to bypass immigration checkpoints. Local police, taxi drivers and city officials often demand bribes or deliver them to kidnappers, according to the migrants and research by government and human rights workers.
Amnesty International says that as many as six in 10 women experience sexual violence during the journey.
Mexican government officials stress that only a handful of complaints are filed against federal immigration agents. The government has sped up the process of returning illegal migrants to their countries. Detention centers are newly built buildings; the migrants ride home in air-conditioned buses.
At a meeting Wednesday, Interior Minister Fernando Gomez Mont, the U.S. ambassador and the governors of the southern Mexican states pledged to work harder to protect migrants.
Like 'merchandise'
The small city of Ixtepec in the humid hills of Oaxaca is a crossroads for illegal migrants moving north on trains. At the edge of town, along the tracks at a shelter for migrants run by the Catholic church, 100 migrants slept on cardboard in the shade, waiting for an afternoon meal, before they move on.
Sergio Alejandro Barillas Perez, a Guatemalan at the shelter, said he was kidnapped in the gulf state of Veracruz this month and held for three days by men who said they worked for the Zetas.
He said his kidnappers demanded $10,000 for him and his girlfriend. "They told me if you don't give us the phone numbers, we'll kill your girlfriend," said Barillas, whose face was still bruised. "We were all in a house, a normal house. When they beat us, they would put a rag in our mouths and they turned on the music, loud, like they're having a party."
He said the kidnappers knocked out his girlfriend's teeth and dragged her away. He and others escaped. He said he does not know what happened to his girlfriend.
"These migrants aren't people -- they are merchandise to the mafias, who traffic drugs, weapons, sex and migrants," said Alejandro Solalinde, the Catholic priest who runs the Brothers of the Road shelter in Ixtepec. "They suck everything out of them."
The priest said that federal authorities do not protect the migrants and that local officials also look the other way, or take their cut from the robbers and traffickers.
Solalinde has battled local authorities who want to shut down his shelter, which feeds as many as 66,000 passing migrants in a year. More than 100 were at the shelter last week.
The priest said many Mexicans are distrustful of the outsiders. In 2008, townspeople became enraged when a Nicaraguan man who was living in Ixtepec was accused of raping a young girl. As police and the mayor were outside the gates at the shelter, Solalinde said, 100 angry protesters got inside.
"They had stones and sticks and gasoline," the priest said. "They wanted to burn us down."

Children Carry Guns for a U.S. Ally, Somalia

MOGADISHU, Somalia — Awil Salah Osman prowls the streets of this shattered city, looking like so many other boys, with ripped-up clothes, thin limbs and eyes eager for attention and affection.
But Awil is different in two notable ways: he is shouldering a fully automatic, fully loaded Kalashnikov assault rifle; and he is working for a military that is substantially armed and financed by the United States.
“You!” he shouts at a driver trying to sneak past his checkpoint, his cherubic face turning violently angry.
“You know what I’m doing here!” He shakes his gun menacingly. “Stop your car!”
The driver halts immediately. In Somalia, lives are lost quickly, and few want to take their chances with a moody 12-year-old.
It is well known that Somalia’s radical Islamist insurgents are plucking children off soccer fields and turning them into fighters. But Awil is not a rebel. He is working for Somalia’s Transitional Federal Government, a critical piece of the American counterterrorism strategy in the Horn of Africa.
According to Somali human rights groups and United Nations officials, the Somali government, which relies on assistance from the West to survive, is fielding hundreds of children or more on the front lines, some as young as 9.
Child soldiers are deployed across the globe, but according to the United Nations, the Somali government is among the “most persistent violators” of sending children into war, finding itself on a list with notorious rebel groups like the Lord’s Resistance Army.
Somali government officials concede that they have not done the proper vetting. Officials also revealed that the United States government was helping pay their soldiers, an arrangement American officials confirmed, raising the possibility that the wages for some of these child combatants may have come from American taxpayers.
United Nations officials say they have offered the Somali government specific plans to demobilize the children. But Somalia’s leaders, struggling for years to withstand the insurgents’ advances, have been paralyzed by bitter infighting and are so far unresponsive.
Several American officials also said that they were concerned about the use of child soldiers and that they were pushing their Somali counterparts to be more careful. But when asked how the American government could guarantee that American money was not being used to arm children, one of the officials said, “I don’t have a good answer for that.”
According to Unicef, only two countries have not ratified the Convention on the Rights of the Child, which prohibits the use of soldiers younger than 15: the United States and Somalia.
Many human rights groups find this unacceptable, and President Obama himself, when this issue was raised during his campaign, did not disagree.
“It is embarrassing to find ourselves in the company of Somalia, a lawless land,” he said.
All across this lawless land, smooth, hairless faces peek out from behind enormous guns. In blown-out buildings, children chamber bullets twice the size of their fingers. In neighborhoods by the sea, they run checkpoints and face down four-by-four trucks, though they can barely see over the hood.
Somali government officials admit that in the rush to build a standing army, they did not discriminate.
“I’ll be honest,” said a Somali government official who spoke on the condition of anonymity because of the delicacy of the subject, “we were trying to find anyone who could carry a gun.”
Awil struggles to carry his. It weighs about 10 pounds. The strap digs into his bony shoulders, and he is constantly shifting it from one side to the other with a grimace.
Sometimes he gets a helping hand from his comrade Ahmed Hassan, who is 15. Ahmed said he was sent to Uganda more than two years ago for army training, when he was 12, though his claim could not be independently verified. American military advisers have been helping oversee the training of Somali government soldiers in Uganda.
“One of the things I learned,” Ahmed explained eagerly, “is how to kill with a knife.”
Children do not have many options in Somalia. After the government collapsed in 1991, an entire generation was let loose on the streets. Most children have never sat in a classroom or played in a park. Their bones have been stunted by conflict-induced famines, their psyches damaged by all the killings they have witnessed.
“What do I enjoy?” Awil asked. “I enjoy the gun.”
Like many other children here, the war has left him hard beyond his years. He loves cigarettes and is addicted to qat, a bitter leaf that, for the few hours he chews it each day, makes grim reality fade away.
He was abandoned by parents who fled to Yemen, he said, and joined a militia when he was about 7. He now lives with other government soldiers in a dive of a house littered with cigarette boxes and smelly clothes. Awil does not know exactly how old he is. His commander says he is around 12, but birth certificates are rare.
Awil gobbles down greasy rice with unwashed hands because he does not know where his next meal is coming from. He is paid about $1.50 a day, but only every now and then, like most soldiers. His bed is a fly-covered mattress that he shares with two other child soldiers, Ali Deeq, 10, and Abdulaziz, 13.
“He should be in school,” said Awil’s commander, Abdisalam Abdillahi. “But there is no school.”
Ali Sheikh Yassin, vice-chairman of Elman Peace and Human Rights Center in Mogadishu, said that about 20 percent of government troops (thought to number 5,000 to 10,000) were children and that about 80 percent of the rebels were. The leading insurgent group, which has drawn increasingly close to Al Qaeda, is called the Shabab, which means youth in Arabic.
“These kids can be so easily brainwashed,” Mr. Ali said. “They don’t even have to be paid.”
One of the myriad dangers Awil faces is constant gunfire between his squad and another group of government soldiers from a different clan. The Somali government is racked by divisions from the prime minister’s office down to the street.
“I’ve lost hope,” said Sheik Yusuf Mohamed Siad, a defense minister who abruptly quit in the past week, like several other ministers. “All this international training, it’s just training soldiers for the Shabab,” he added, saying defections had increased.
“Go ask the president what he’s accomplished in the past year,” Sheik Yusuf said, laughing. “Absolutely nothing.”
Advisers to President Sheik Sharif Sheik Ahmed say they have fine-tuned their plans for a coming offensive, making it more of a gradual military operation to slowly take the city back from the insurgents.
Awil is eager for action. His commanders say he has already proven himself fighting against the Shabab, who used to bully him in the market.
“That made me want to join the T.F.G.,” he said. “With them, I feel like I am amongst my brothers.”

Cuba—A Way Forward

In a 1980 interview, Gabriel GarcÃa Márquez told The New York Times that he had spent three years writing a book about life in Cuba under Fidel Castro. But, he said, “now I realize that the book is so critical that it could be used against Cuba, so I refuse to publish it.”
In view of the Colombian author’s past concern for the victims of Latin America’s authoritarian regimes, it seems likely that what he called a “very harsh, very frank book” addressed Castro’s systematic repression of dissent: the rigged trials behind closed doors, the abysmal “reeducation” camps, the long prison sentences. Castro’s methods may have seemed relatively tame when compared with the mass slaughter of civilians by US-backed regimes throughout the region, for example in Guatemala. Yet as the cold war ended, these dictatorships gradually gave way to civilian rule, and the Castro government was left standing as the only one in the hemisphere that continued to repress virtually all political dissent. GarcÃa Márquez’s book remained unpublished.
The fact that Latin America’s most renowned writer would censor himself in this way may actually say more about the plight of Cubans under Castro than anything in his manuscript. For the notion that to criticize Cuba is to abet its more powerful enemies was, for Fidel Castro, the key to achieving what his prisons alone could not—ensuring that his critics on the island remained isolated and largely ignored.
For years, many believed that the last thing keeping the region’s democratic tide from sweeping across Cuba was the unique force of Fidel Castro’s character—the extraordinary combination of charisma and cunning with which he inspired and corralled his supporters, provoked and outmaneuvered his enemies, and projected himself onto the big screen of world politics. Under his leadership, Cuba had made impressive gains in health care, education, and the eradication of extreme poverty. But the promise of the Cuban Revolution had been undercut by years of chronic deprivation, exacerbated by the US embargo, and brought to the brink of collapse by the dissolution of the Soviet Union, which had propped up the island’s economy for decades. Democracy would come to Cuba—the thinking went—as soon as Fidel Castro was no longer standing in its way.
Then in June 2006, his health failing, Castro was forced to step down formally after nearly five decades in power. And nothing happened. No popular uprising in the streets, no Party shake-up, no coup. Instead, his younger brother, Raúl, took up power and, though lacking Fidel’s charisma, was able to keep the country running smoothly. Within months, it seemed clear that Cuba’s single-party system could continue without Fidel at the helm.
Some still held out hope that Raúl Castro would begin a process of political reform, a Cuban perestroika. Those looking for signs of an opening pointed to several of Raúl’s early actions, including state-sponsored public forums ostensibly aimed at encouraging criticism of government policies and the signing of the two major international human rights treaties.
But was Raúl Castro allowing genuine criticism of his government? Was the repressive machinery being eased or even dismantled? A year ago Human Rights Watch set out to answer these questions. We knew it wouldn’t be easy. The Cuban government welcomes tourists to the island, but has for years denied access to international rights monitors. Foreign journalists are followed around by undercover agents: their e-mails are monitored and their phones tapped. Those who publish in-depth stories on controversial issues face expulsion.
Our first step was to write to the Cuban government requesting authorization to visit the island. Human Rights Watch does not normally request permission to do its work, but it seemed like a good way to test whether the government’s attitude had changed. The government never responded.
We then got in touch with several local dissidents. Outside of Cuba, people often refer to “the dissidents” as though they are a single, unified political group. They are not. They do not share a single ideology or objective. Rather, the dissident community is made up of a variety of Cubans scattered across the island, some of whom belong to small groups, and others who work alone. A dissident may be someone who writes articles critical of the government, attempts to form an independent labor union, or simply refuses to attend meetings of a local revolutionary committee. What ties these people together is that they engage in activities that the Cuban government considers contrary to its policies, and therefore “counterrevolutionary.”
We obtained reports of alleged government abuses from several unauthorized human rights groups in Cuba, whose leaders have persevered over the years despite tapped phone lines, restricted mobility, frequent police raids, and periods in jail, relying on a few committed volunteers to compile lists of political prisoners and testimony about violations. But tracking down the alleged victims to corroborate these reports often took weeks. E-mail access on the island is virtually nonexistent, and many families outside of Havana do not have phone lines. When we were able to get through by phone, some people were too frightened to speak. Others spoke cryptically to avoid arousing the suspicion of listening ears. Still others spoke freely until their lines went dead, mid-sentence. While we did manage to conduct some full-length interviews, it became increasingly clear that the only way to get the full story would be to visit the island.
It would prove to be the most difficult research mission Human Rights Watch had undertaken in the region in years. Our team entered on tourist visas and traveled the length of the island by car, telling no one in advance that we were coming and never staying in any town for more than one night.1 The fear we had sensed over the phone was even more palpable on the ground. Some people became so uneasy talking about government abuses that we cut short the interviews and moved on. Several alerted us to watching neighbors who monitored suspicious activity for the local Revolutionary Defense Committees. A Baptist minister, when asked about human rights, told us quietly that what we were doing was illegal and asked us to produce identification.
Yet many people welcomed us into their homes, where they spoke frankly of their experiences. Small boxes and folders were brought out from beneath beds and inside kitchen cabinets, with official documents that corroborated their stories. Among much else, we were shown a court ruling from a dissident’s trial, which his wife and children were not allowed to attend; a parole order warning a journalist that he could be returned to prison at any time; a letter denying a critic of the government permission to travel.
Piece by piece, the evidence stacked up. The human rights treaties had not been ratified or carried out. The “open” forums to discuss government policies were governed by strict rules that prohibited any talk of reforming the single-party system. More than one hundred political prisoners locked up under Fidel remained behind bars, and Raúl’s government had used sham trials to lock away scores more. These new prisoners included more than forty dissidents whom Raúl had imprisoned for “dangerousness.” The most Orwellian provision of Cuba’s criminal code, this charge allows authorities to imprison individuals before they have committed a crime, on the suspicion that they might commit one in the future. Their “dangerous” activities included failing to attend pro-government rallies, not belonging to official party organizations, and simply being unemployed.
We published our findings on November 18, 2009.2 It was only then that we received a response from the Cuban government: a public statement, published that day, declaring our report “illegitimate and illegal.”
If the crime of the political prisoners is essentially voicing their opinions, a main function of imprisoning them is to isolate them from their potential audiences. Ramón Velásquez Toranzo taught theater until his political activities cost him his job. In December 2006, he set out on a silent march across the island to call for the release of Cuba’s political prisoners. On the road he was repeatedly threatened and beaten by civilian Rapid Response Brigades, according to his wife and daughter, who accompanied him. He was twice detained and forcibly returned to his home by police. On his third attempt, he was taken to prison and given a three-year sentence for “dangerousness.” Raymundo Perdigón Brito, who had worked as a security guard before he too was fired for “counterrevolutionary” activities, wrote articles critical of the government for foreign websites until, in 2006, he was sentenced to four years in prison for “dangerousness.” Digzan Saavedra Prat, a shoemaker, documented abuse cases for a local human rights group, an activity that cost him his job and caused him to be convicted of “dangerousness” in 2008. His indictment accused him of “being tied to persons of bad moral and social conduct,” “setting a bad example for the new generation,” and “thinking he is handsome.”
Those who continue to speak out while in prison are isolated even further. One man was arrested and sentenced to four years for “dangerousness” after he tried to hand out copies of the Universal Declaration of Human Rights in public in 2006. In 2008, he attempted to commemorate International Human Rights Day (December 10) by reading the Universal Declaration aloud to fellow inmates. But according to his wife, a guard cut him short, ordering him to eat the text—literally. When he refused, he was beaten, thrown into solitary confinement for weeks, and sentenced in a closed-door hearing to six more years in prison for disrespecting authority.
We heard many similar accounts from former prisoners and the relatives of current ones. Those who refused “reeducation” or questioned prison conditions were thrown into solitary confinement cells measuring three by six feet for weeks, even months, on end. Their visits were cut off, phone calls denied, and letters confiscated. Since Cuba has for years refused to grant human rights monitors access to its prisons, it is difficult to get firsthand general accounts of the conditions inside. The most comprehensive—by the sixty-seven-year-old journalist Héctor Maseda Gutierrez, currently serving a twenty-year sentence for his writing—had to be smuggled out of prison virtually page by page. It is titled “Buried Alive.”
While not all dissidents are locked up, nearly all are effectively imprisoned on the island itself. In clear violation of international law, the Cuban government requires its citizens to obtain permission to leave the country, and those marked as “counterrevolutionaries” are generally denied it. The prominent blogger Yoani Sánchez—whose posts comment on the daily indignities of life in Cuba—has three times been refused permission to leave the country, twice to accept international prizes and once, in March 2010, to attend a conference on the Spanish language.
The emergence of a nascent blogosphere has been heralded as a sign that Cuba is opening up, yet the government systematically blocks critical websites and strictly controls access, forcing bloggers to upload their posts using thumb drives and illegal back channels. Because an hour’s use costs roughly one third of Cubans’ monthly wages, and since there are few connections outside of cities, the average Cuban has no access to the Internet. Although Yoani Sánchez was named one of Time magazine’s one hundred most influential people, most Cubans on the island have never even heard of her, let alone read her blog.3
The Cuban government also seeks to isolate dissidents from their communities. They are fired from their jobs and blacklisted from employment. They are subjected to public “acts of repudiation,” in which mobs surround their homes, chant insults, throw stones, and sometimes assault them in plain view of their neighbors. Friends and family members are warned to keep their distance, lest they too be branded counterrevolutionaries and punished. Under the “dangerousness” provision, even spending time with someone who is considered “dangerous” is punishable, a kind of “dangerousness” by association.
“People who come to my house are immediately called by state security and reprimanded,” Eduardo Pacheco OrtÃz, a human rights defender and former political prisoner, told us. “Then these people—for fear of losing their jobs, for fear that [the authorities] will take it out on someone in their family—simply stop talking to me.”
After Ramón Velásquez Toranzo was sentenced to four years for his silent march across the island, his son René, who had not marched with his father or considered himself “political,” was fired from his longtime job without explanation, then repeatedly denied work on the grounds that he was not “trustworthy.” Members of the local Revolutionary Defense Committee regularly harassed and threatened him in public. Police warned his friends that they would get in trouble if they kept hanging around him, until he had few friends left. His girlfriend was forbidden by her parents from seeing him. “Some days I wake up and I think: I have nothing. I am nobody. I have no dreams left for my future,” René told us.
Some outside observers contend that the existence of around two hundred political prisoners has little impact on the lives of the 11 million other Cubans. But as the blogger Reinaldo Escobar recently wrote, “Why then does an index finger cross the lips, eyes widen, or a look of horror appear on the faces of my friends when at their houses I commit the indiscretion of making a political comment within earshot of the neighbors?”4 The political prisoners may be small in number, but they are a chilling reminder to all Cubans of what has been a basic fact of life for half a century: to criticize the Castros is to condemn oneself to years of enforced solitude.
In addition to declaring our report illegal, the Cuban government also claimed it was part of a broader effort to “trample” Cuba’s “right to free self-determination and sovereign equality.” This charge, while no more credible than the first, warrants serious attention, for it is reflected in the concerns of GarcÃa Márquez and many others outside of Cuba who have for years been reluctant to criticize the Castros.
Invoking national sovereignty may be the most common tactic used by governments around the globe—and across the political spectrum—to counter criticism of their abusive practices. It is the international equivalent of the “states’ rights” claim that segregationists in the US South used for years to defend their racist laws and policies. The aim is to shift the focus of public concern from the rights of abuse victims to the rights (real and imagined) of the states that abuse them.
What sets the Castro government apart from most others that employ this tactic is the fact that Cuba has indeed, for five decades, faced an explicit threat to its national sovereignty—coming from the United States, a superpower ninety miles off its shores. In the 1960s, the threat took the form of covert military action, including the failed Bay of Pigs invasion and multiple botched assassination attempts. It continues in the form of the economic embargo established by President Eisenhower in 1960, later expanded by President Kennedy, and eventually locked in place by the 1996 Cuban Liberty and Democratic Solidarity Act. Also known as “Helms-Burton,” the law prohibits the president from lifting trade restrictions until Cuba has legalized political activity and made a commitment to free and fair elections. It also prohibits lifting the embargo as long as Fidel and Raúl Castro remain in office. In other words, it requires that Cubans be free to choose their leaders, but bars them from choosing the Castros. It is thus a program to promote not only democracy but also regime change.
It is hard to think of a US policy with a longer track record of failure. The embargo has caused much hardship to the Cuban people but done nothing to loosen the Castros’ hold on power. Instead it has provided the Cuban government an excuse for the country’s problems. Billboards line the roads outside Havana with slogans like “Eight hours of the blockade is equivalent to the materials required to repair 40 infant care centers.” The excuse is effective because it is at least partly true.
The US policy has also served the Castros as a pretext for repressing legitimate efforts to reform Cuba from within. The most notorious example of the past decade came in response to the Varela Project, a grassroots campaign designed to take advantage of a constitutional provision that allows a national referendum on any reform proposal that receives 10,000 signatures. The organizers spent years holding meetings and gathering signatures, enduring repeated harassment by authorities, attacks, and arrests. In May 2002, they delivered more than 11,000 signatures to the National Assembly.
The response was crushing. Rather than put the referendum to a vote (as required by law), the Castro government countered with its own referendum, which proposed amending the constitution to declare the socialist system “irrevocable.” This referendum passed, according to the government, with 99 percent of the public’s support. Not long afterward, the government began its most aggressive crackdown in years, arresting seventy-five “counterrevolutionaries,” including many Varela Project leaders, and sentencing them to an average of nineteen years in prison.
In a news conference immediately following the crackdown, Cuba’s foreign minister claimed that the Varela Project had been “part of a strategy of subversion against Cuba that has been conceived, financed, and directed from abroad with the active participation of the US Interests Section in Havana.” The United States had indeed been supporting civil society groups in Cuba for decades. In 2002, the year prior to the crackdown, the State Department devoted $5 million to “democracy promotion” in Cuba, channeling it through the US Interests Section in Havana and nongovernmental groups based mostly in Miami. For instance, several Cuban journalists received salaries from US-funded Internet publications critical of the Castro government.
Nonetheless, many of the seventy-five were convicted without any evidence of support—direct or indirect—from the US government. And in those cases where the Cuban government did show they received US support, it provided no credible evidence that the recipients were engaged in activities that would be considered illegal in a democratic country.
According to Cuban court documents, the support took the form of supplying, through the US Interests Section in Havana, equipment like fax machines (“used systematically in sending information to counterrevolutionary cells located in Miami”), books (“all with a pronounced subversive content”), and medicine (“with the explicit purpose of winning over addicts to their cause”). In other cases, the prisoners had been paid by the US for filing articles or radio reports for foreign outlets, or visiting the US Interests Section, where they had “access via the Internet to the websites of enemy publications…[and] counterrevolutionary dailies like the Nuevo Herald, the Miami Herald, Agence France-Press, Reuters, and the American television channel CNN.”
Many governments require civil society groups to register funding they receive from foreign states. But for Cubans there is a catch: to register funding from the US government is to admit to a crime punishable with a prison sentence of up to twenty years—even when the funding merely supports activities like human rights monitoring, labor organizing, and establishing independent libraries. In fact, these activities are illegal in Cuba even when pursued without US support. The criminal code explicitly outlaws “actions designed to support, facilitate, or collaborate with the objectives of the ‘Helms-Burton Law.’”
Since promoting democratic rule is a central objective of Helms-Burton, any action taken toward that end can therefore be considered a crime. In this way, just as criticism of the Castros is equated with abetting their enemies, promoting democracy is equated with US-sponsored regime change.
But if the pretext for the crackdown was bogus, it nonetheless served a crucial function: to recast the government’s repression of its citizens as the story of a small nation defending itself against a powerful aggressor. It was the same tactic that Fidel Castro had been employing to brilliant effect for decades. By casting himself as a Latin American David besieged by a US Goliath, he usurped the role of victim from his prisoners. The sleight of hand worked because, for many outside of Cuba, the indignation provoked by the US embargo left little room for the revulsion they would otherwise feel for Fidel Castro’s abuses.
Raúl Castro has adopted this same tactic, so that when outsiders hear of Cuba’s political prisoners, many think first of what the US has done to Cuba, not what Cuba has done to its own people. While the prisons, travel restrictions, and information controls make it difficult for Cuban dissidents to get their stories out to the world, the Castros’ portrayal of Cuba as a victim makes audiences abroad less willing to hear these stories. The effect is to seal Cuba’s prisoners off from international sympathy and reinforce their prolonged solitude.
Once a year, for nearly two decades, the UN General Assembly has voted overwhelmingly to condemn the US embargo. In 2009, the resolution passed 187–3, with only Israel and Palau siding with the United States. While this condemnation is deserved, there is no such UN vote to condemn Cuba’s repressive policies, or comparable outrage about its victims.
This discrepancy is particularly pronounced in Latin America, where the long history of heavy-handed interventions and outright coups has left an abiding aversion to US bullying. Even leaders whom one might expect to be sensitive to the prisoners’ plight choose to remain silent. President Luiz Inácio Lula da Silva of Brazil was himself imprisoned by a military dictatorship, and former President Michelle Bachelet of Chile is the daughter of a political prisoner (and herself a torture victim). Yet in recent years, both have made state visits to Cuba in which they embraced the Castros and refused to meet with relatives of political prisoners.
Meanwhile, an increasing number of leaders have praised the Castro government as a standard-bearer for the region. President Evo Morales of Bolivia says that Cuba “teaches the entire world how to live with dignity and sovereignty, in its permanent fight against the North American empire.” President Rafael Correa of Ecuador speaks of the “Latin American pride” he feels when witnessing Cuba’s ongoing revolution, which “secured the reestablishment of human rights for all Cuban men and women.” Perhaps the most fervent supporter is President Hugo Chávez of Venezuela, whose government has taken over the role, once filled by the Soviet Union, of keeping the Cuban economy afloat by providing millions of barrels of subsidized petroleum. Chávez calls Cuba’s revolution “the mother” of all Latin American liberation movements, and Fidel Castro “the father of the motherland.”
Over the past decade, a growing number of voices in the United States—including editorial boards, research organizations, and advocacy groups—have called for an end to the embargo. But they are far from winning the policy debate in Washington. Anti-Castro hard-liners within the Cuban-American community continue to wield disproportionate influence, even if their dominance has waned in recent years.
The opponents of the embargo have failed to be persuasive. Many have sought to play down the scope of repression in Cuba out of a concern—similar to GarcÃa Márquez’s—that criticism of the Cuban government will only strengthen the hand of the anti-Castro hard-liners. But by making this strategic choice, they have undermined their credibility among the very people they need to persuade: those who are justifiably concerned about Cuba’s political prisoners. Moreover, they are unable to offer a politically workable solution to members of Congress, who will never vote to end the embargo if this will have no effect on the regime’s abuses.
The embargo must go. But it is naive to think that a government that has systematically repressed virtually all forms of political dissent for decades will cease to do so simply because the embargo has been lifted. Nor is it realistic, given the effectiveness of the Castros’ repressive machinery, to believe that the pressure needed for progress on human rights can come solely from within Cuba. The embargo needs to be replaced with a policy that will bring genuinely effective pressure on the Castro government to improve human rights.
For this to happen, the United States must make the first move. President Obama should approach allies in Europe and Latin America with an offer to lift the US embargo if the other countries agree to join a coalition to press Cuba to meet a single, concrete demand: the release of all political prisoners.
Some governments are sure to rebuff the offer, especially in Latin America. But for many others, the prospect of ending the embargo will remove what has long been the main obstacle to openly condemning the Cuban government’s abuses. And concentrating this multilateral effort exclusively on the issue of political prisoners will make it far more difficult for leaders who say they respect human rights to remain silent.
The new coalition would give the Cuban government a choice: free its political prisoners or face sanctions. Unlike the current US embargo, these sanctions should directly target the Cuban leaders—by denying them travel visas or freezing their overseas assets, for example—without harming the Cuban population as a whole. Ideally this ultimatum alone would suffice to prompt the government to release its prisoners. But even if it did not, the new approach toward Cuba—multilateral, targeted, and focused on human rights rather than regime change—would fundamentally transform the international dynamic that has long helped the Castros stifle dissent. The Cuban government’s efforts to isolate its critics at home would lead to its own isolation from the international community.
In the absence of such a shift, Cubans seeking reform will continue to face daunting odds. Any hope of drawing attention to their cause will require desperate measures, such as the hunger strike recently carried out by Orlando Zapata Tamayo, a dissident who had been in prison since the 2003 crackdown. For eighty-five days, Zapata Tamayo’s protest went largely unnoticed. It was only when he finally starved to death in February—becoming the first Cuban hunger striker to perish in almost forty years—that the world reacted. The European Parliament passed a resolution condemning his death as “avoidable and cruel” and calling for the release of all political prisoners. The Mexican and Chilean legislatures approved similar declarations.
The Cuban government responded in familiar fashion: it blamed the US. The state news organ claimed that Zapata Tamayo had been “thrust into death” by the “powerful machinery of the empire.” When several other dissidents began hunger strikes in the following days—including Guillermo Fariñas, a journalist who at this writing is reportedly near death—Cuban authorities dismissed them as “mercenaries” of the US. Decrying what he called a “huge smear campaign against Cuba,” Raúl Castro told the Cuban Congress, “We will never yield to blackmail from any country.”
Raúl Castro seems confident that he can defuse this latest challenge with the same sleight of hand his brother used so effectively in the past. And indeed, the flurry of condemnation following Zapata Tamayo’s death appears to have already faded. But more than just a tactical move, Raúl’s response reflects a vision for Cuba’s future that does not bode well for those desiring change. It is the vision he set forth on the fiftieth anniversary of the Cuban Revolution in 2009, addressing the nation from the same public square where Fidel had first proclaimed victory:
Today, the Revolution is stronger than ever…. Does it mean the danger has diminished? No, let’s not entertain any illusions. As we commemorate this half-century of victories, it is time to reflect on the future, on the next fifty years, when we shall continue to struggle incessantly.
A story of struggle always needs an adversary, just as a claim to victimhood needs an aggressor. After playing this role for fifty years, the United States is now in a unique position to bring about change in Cuba: when it stops acting like Goliath, the Castro government will stop looking like David. Only then will Cuba’s dissidents be able to rally the international support they need to end their long years of solitude.

Obama needs to support Egyptians as well as Mubarak

When President Obama called for a "new beginning" in U.S. relations with the Muslim world a year ago, he picked Cairo as the setting for his speech. It was a provocative choice, the capital of a close ally of the United States but also of the three-decades-old autocracy of Hosni Mubarak.
When Obama declared his commitment to "governments that reflect the will of the people" and said that leaders "must maintain your power through consent, not coercion," Egyptians thought they heard a not-so-subtle reference to their aging leader. One enthusiastic Egyptian shouted, "Barack Obama, we love you!" -- the only such interjection during the address.
A year later, Egyptians are scratching their heads about why Obama came to Cairo. In meetings in Cairo this week, Egyptian civil society and political activists across the spectrum voiced their disappointment, asking, "I know they're busy, but can't the Obama administration spare any time at all for what is going on inside Egypt?" and saying resignedly of the president, "He seems like a nice guy, but I guess he's just not going to do anything for us."
The disappointment is understandable. As Egypt heads into controversial parliamentary elections in fall 2010 and a presidential election in 2011, the Obama administration has been tone-deaf, intent on continuing to improve relations with the increasingly brittle and unpopular Mubarak regime. It has cut democracy assistance spending in Egypt by half, agreed to forbid assistance from the U.S. Agency for International Development to groups that lack the government's stamp of approval, and is discussing a future "endowment" that would commit the United States to years of assistance with diminished congressional oversight. When administration officials have privately raised questions about democracy or human rights with the Egyptian government, their carefully calibrated "quiet diplomacy" has been dismissed or ignored. Obama himself politely asked Mubarak during an August 2009 Oval Office meeting to fulfill his 2005 pledge to lift the state of emergency under which Egyptians have been repressed since 1981. Mubarak brushed him off. Last month, Mubarak renewed the state of emergency for another two years, conveniently the period during which parliamentary and presidential elections will occur. The Obama administration called it "regrettable."
Meanwhile, Mubarak is in ill health and may not even make it to the next presidential election. His regime has systematically excluded or discredited new leaders who enjoy any public support, leaving the field of potential successors depressingly impoverished. One would think that under the circumstances both Egyptians and the U.S. government would be working to put in place an open political process so that any new leader could win the support of the people and thus ensure order in this important nation. But the Egyptian government is paralyzed by the aging Mubarak's refusal to look beyond his own rule. And the Obama administration, in pursuit of an illusory stability, stands mute and passive as the predictable train wreck draws nearer.
This administration prides itself on its progressive approach to this post-Cold War world, but it is repeating the mistake that Cold War-era administrations made when they supported right-wing dictatorships -- right up until the point when they were toppled by radical forces.
Obama's Cairo speech had the admirable goal of improving relations with the Muslim world, but the manner in which the administration has pursued this goal has been flawed from the beginning. It has focused almost exclusively on building bridges with leaders and governments. Yet in Egypt, and in Iran, a gulf has opened between the government and the citizenry. Obama has strengthened ties with the aging Mubarak while ignoring the concerns of Egypt's increasingly restive population. "What about us?" one prominent democracy activist asked. "Do we count for anything in this U.S.-Egypt relationship?"
When rebels ousted the corrupt government in Kyrgyzstan in April, they noted angrily that the United States had never stood up for their rights in the face of rigged elections and human rights abuses, placing a clear priority on strategic cooperation with the government. Watch out. If the Obama administration does not figure out how to make clear that it supports the political and human rights of Egyptian citizens, while cooperating with the Egyptian government on diplomatic and security affairs, people will be saying that about the United States in Cairo one of these days -- and maybe sooner than we expect.
There is still time to turn around this failing policy. Vice President Biden visits Egypt next week. There are, as always, numerous crises on the agenda. But if the administration wants to try to head off the next crisis, in Egypt, then Biden should use the opportunity to have a frank talk with Mubarak and other senior officials. In private, he can explain why it is so important, for both Egypt and the United States, that Mubarak take immediate steps to open the political process in this difficult period of transition. In public, Biden needs to make clear that the United States stands for free, fair and competitive elections -- for Egyptians, just as for everyone else.
Given the sorry history of the United States supporting the oppressors rather than the oppressed in that part of the world, such a commitment would be the kind of "new beginning" the Egyptian people seek.
